Stations have an incentive to keep them accurate. Quoting from

Civil penalties of up to $32,500 per violation per day can be assessed for non-compliance with EPA’s ULSD

pump labeling or downgrading limits, the Agency may commence an enforcement action,
including the collection of a civil penalty, against the person who owns, leases, operates, controls
or supervises the facility where the violation was found. EPA may assess a civil penalty of up to
$32,500 per day for each labeling or downgrading violation, plus the economic benefit or savings
resulting from the violations."

says their may be caps to the penalties.

Sorry, not true yet...

Just to repeat, aside from Alaska and California, ULSD isn't *required* in all states until December 2010, though 80% of a refinery's output today must be ULSD. If you don't see a ULSD sticker you should assume that it is still LSD (as I discovered at a Las Vegas truck stop). All diesel sold in California is already ULSD. See
