As I understand it (and I could be wrong on this), Navistar was mandated by the consent decree to have their engines '04 compliant by October of '02. The 7.3 was apparently not able to meet the '04 emissions standards (let alone the '07 standards which will be in effect before '08), therefore, it was replaced by the 6.0, which could. Since Ford buys the engines from Navistar, they don't really have a hand in this other than as a consumer of Navistar's products.
The other manufacturers (including Cummins) are also under a consent decree, but Navistar was singled out for their misrepresentation of emissions compliance and were given a harsher decree than the other companies.
