props to you 44444444 there is absolutly no way i would be able to stay calm and keep a cool head. i would be there every day all over those people at the dealer raisin hell. i just registered to this site after reading this thread im really curious as to what the outcome is. it makes me wonder what kind of techs worked on my truck the 5 times it went in for warranty work before it went out. and wouldnt you know it at 124k i have a blown egr cooler that i just changed this weekend. it took me 3 days to take everything off and put the delete kit on and reinstall everything and this coming weekend i have to do it all again because i have an intake manifold leak on the drivers side rear.
i have had an egr cooler replacement on warranty ( and several other things) before and when i examined the cooler i pulled off you can clearly see where the welds were grownd off and new welds were put on it like they just rebuilt the thing.
when i had the intake off it is really easy to drop something down in there and i never seen anything that looked like the marks on your piston but i do think that the marks look like it would be a glow plug tip that was broke off and has been smashed around in there for a while especially with the now missing piece of wire that was there. the foreign object was probally there sitting on top of the piston when they tore it apart to and they either tossed it or just didnt think anything about it.
anyways i sure hope you get this ordeal settled with them. you said you were in south texas i am in s.e. texas if there is anything i may could do to help let me know. if its a dealer near me i would be more than happy to give them a piece of my mind as i dont care for any of them around here anyways from dealing with them.
As I stated in an earlier post Ford bought mine back after I retained an attorney. When they filed suit, they specifically outlined the issues based on two things: 1. Lemon law which doesn't apply but 2. the Magnuson–Moss Warranty Act which clearly applies here. Have you spoken with an attorney Re: the MMWA specifically? I think you could kick them square in the headlights with this (based on what I know from my case with the MMWA.

What problems were you having that your truck was repurchased?
It started with the bed plate leak and progressed into replacement of 1/2 a turbo the a whole turbo. EGR, Oil cooler several sensors Hi pressure oil pump (shield I think). All in all, it paled in comparison to what some other posters are going through. It was just in the shop constantly (like 2 months in the previous 12) and I'd had enough.
I really just wanted to be compensated for the time my truck was unavailable. They initially offered $1500 and told them to pound sand. They came back with a total repurchase (including costs for my bedliner, registration, and a few other things). I was surprised to say the least.

Wow, I can see how that would be bitter sweet though. I am trying to decide if I want to keep my '07 out of warranty or not. I have not had one ounce of trouble from the engine. I am not in a real good spot here. I know myself too well. If I decide to trade it, I know I'll miss my truck. If I keep it and have a problem, I'll be kicking myself. Ha!

How does the MMWA pertain to this specific problem?
Under the Magnuson-Moss Act, a vehicle buyer is guaranteed that certain minimum requirements of warranties must be met. Although the Act does not require a vehicle manufacturer to provide purchasers with a warranty, if a warranty is provided, the Act makes it easier for buyers to file and win lemon law cases by making a breach of warranty claim under federal law, thereby allowing consumers to recover court costs and reasonable attorneys' fees.
Lemon law cases can be brought under the Magnuson-Moss Act even if your state’s Lemon Law doesn’t cover your claim. For example, if your warranty and/or the lemon law period is expired, you can still bring a breach of warranty claim under the Magnuson Moss Act as long as the problems occurred during the vehicle’s warranty period.
This is exactly what applied in my case and it obviously worked. But it does suck not having a truck and we really liked that truck. makes me sick really. The kicker for me was them not even offering me a deal on another one. I volunteerted to buy another Ford and they blew me off. I thought the'd show me an express lane to a new one (not a replacement but I'd buy it). nothing...crickets.

I've been being quiet because I discovered that the (are you ready for this?) dealership OWNER is an old classmate of mine! This is from over 40 YEARS ago! So I've been hoping for a solution that wouldn't involve lawyers.
I'm still negotiating but (naturally) they want to replace the EGR cooler again......this time at MY expense and that's the THIRD EGR COOLER FOR MY TRUCK, .....IF I'm willing to pay for it! They're quoting a rock bottom price....about 3900 bucks, but still ridiculous when I had a VALID WARRANTY going into this place and it's cost me $2000 in rentals just to discover that Ford is no longer honoring it's legitimate warranties.
I need some advice....is it just wishful thinking to believe this 6.0L motor will stay together with the stock EGR cooler intact?
One way or the other though, it looks like I'm going to court with Ford Motor Company. I really don't want to sue my old classmate, and he wasn't the owner when most of this occurred. (but boy, what a lawsuit it's gonna be if Ford doesn't settle)
A business like a dealership might carry some contingency insurance coverage for situations like this one. Even if they have such a policy, they might be reluctant to file a claim because of a high deductible or because it will drive their premiums up, and in that case, it's in their best interests to wait you out. From where I sit, it's probably going to take a lawyer (or a letter from one) to get the ball rolling.
If your old classmate objects to you pressing the issue, just remind him of how Vito Corleone categorized these situations: "nothing personal, just business."

There is at least one aftermarket EGR cooler with stouter guts (uses stainless tubing). Not sure how well it works, and it doesnt really solve the oil cooler constriction issue, which is most often the root cause of EGR cooler failure.
Bottom line: keeping the coolant system clean is critical on these engines. The factory recommended maintenance schedule is not sufficient if you ask me. Coolant should be replaced way before 100k miles, IMO.

This is why I don't feel sorry for you. (well I do, but the sugar approach sometimes has to change to the salt approach if you know what I am saying!)
I look at that picture of the imbedded object ghosting in the piston top. It screams injector tip if you ask me. But if it is, YOU have to prove it to the world or you don't have a case.
So where is your truck? Why haven't you had it removed from the dealership and meticulously inspected by a reputable impartial professional diesel shop? The dealer should have been able to tear down and remove all 8 injectors, show them all to you and say there you go - not an injector issue. It was a "foreign object" or a very small UFO that got sucked into your intake system.
Why haven't you obtained a broken 6.0 injector from anywhere, tore it down, and compared the pieces / wiring with what you found originally? Pound the injector tip into a piece of aluminum and see what impression it leaves.
This isn't diesel CSI ! If you have a case, start building it. If it wasn't an injector tip, then it was something upstream left behind from a previous job. Prove what it was (it was obviously strong metal) and where it came from. If it belonged on the truck and they were the last ones to touch it, you have the exclusive opportunity to prove the negligent technician was responsible.
Your old high school buddy really isn't your friend here. You find the smoking gun here mister, because the dealership hid it on you already !!!!!!!!!!!!!!
