I would say it depends on the shop. Find one that looks like they accept cash only and you should be fine.

Roll your windows down and turn the a/c off. They won't check.

I used to be a Texas certified inspector and I will tell you most will check it. You could try rolling in with the windows down and see what happens. They may just not think about it, but if he sees it on the rear he will probably roll up the front to check.

It was about 12 years ago, but it was 20%. I have since moved to another state and have not kept up with the laws.

I guess it depends on the place you take it. I've always gone to small independent shops to get my inspections done. Never had any trouble getting a sticker, unless emissions failed (gasser)! Never had 5% tint either though!

They are getting real tough on the inspection stations, at least here in NC they actually will go in under cover and try bribe people to pass their car etc... if they get caught it is a big fine, and multiple infractions they can loose their inspection permit. I have 5% and now only have one place I can take it where my buddy works. This doesn't mean you still can't get a ticket for it.

The tint law in Texas is a little weird. For inspection purposes you can have tint to 20%, however a cop can give you ticket if you have any darker than 35%. I run around with 18% on my windows and have never had a problem with inspection or tickets.

They do that in Texas as well. I got very lucky one time and had this guy come in with a POS and the smog pump was removed. Everything else passed fine, just no air pump bolted where it was supposed to be. (before smog checks, just visual) He tried and tried and tried to get me to pass him. He offered cash and kept trying. Turns out he was the undercover guy running around town trying to get people to pass him.
Not sure how they track it now, but in my town the inspectors would put a big "X" on the back of the sticker if it failed so others would know that the vehicle had been inspected some where before.
I have a ton of silly stories from doing inspections. Amazing what people will try and how mad they get when they fail.

This link should clear up some confusion. I'm not sure how a cop can give a ticket for something that is not law.

The one thing you miss here is that when you have super dark tint LEO's will pick on you much more. A couple of LEO friends say that deep tint makes them nervous and makes them suspicious of what you are hiding.
Their experience has been that dark tint is also involved in more night time "didn't see him" accidents. Not sure how scientific the last part is.

Why would the law be different than the inspection standard? That makes no sense. What a cluster.
