> A lot of stations don't keep their signs up 2 date.
Stations have an incentive to keep them accurate. Quoting from
www.marama.org/diesel/ULSD/ULSD_issue_paper.pdf
"The new standards provide strong incentives for suppliers to provide the proper ULSD fuel formulation.
Civil penalties of up to $32,500 per violation per day can be assessed for non-compliance with EPA’s ULSD
fuel standards, or for misrepresentation of the sulfur level of diesel fuel."
Also see
www.epa.gov/OMS/renewablefuels/420b07019.pdf for the big stick (for biodiesel makers):
...for a civil penalty of up to $32500 per day per violation (see 40 CFR 80.5)
and quoting from the EPA Pump Labeling Fact sheet at
http://www.ndpetroleum.org/News/Pump...%2012-8-06.pdf
"Enforcement Process When A Pump Labeling Violation is Found
When EPA determines that a retailer or wholesale purchaser-consumer has violated the diesel
pump labeling or downgrading limits, the Agency may commence an enforcement action,
including the collection of a civil penalty, against the person who owns, leases, operates, controls
or supervises the facility where the violation was found. EPA may assess a civil penalty of up to
$32,500 per day for each labeling or downgrading violation, plus the economic benefit or savings
resulting from the violations."
though
www.epa.gov/compliance/resources/policies/civil/penalty/penaltymod-memo.pdf
says their may be caps to the penalties.
> I believe all stations in the US are currently selling ULSD only.
Sorry, not true yet...
Just to repeat, aside from Alaska and California, ULSD isn't *required* in all states until December 2010, though 80% of a refinery's output today must be ULSD. If you don't see a ULSD sticker you should assume that it is still LSD (as I discovered at a Las Vegas truck stop). All diesel sold in California is already ULSD. See

for the gory details.
