Any advise?

Been going through buy back process for my 6.0 diesel. Fords latest offer was to give me back $6500, pay attorney fees, and me keep the truck. Or wait for a court date in December to settle on giving me most of my money back on the truck, which would come to maybe around $40,000, and take back my 6.0.
My 6.0 had a remanufactured motor put in back in november, so I guess it's like a 2007, no problems so far. It has 64000 miles.
I'm undecided if I should keep it,or get a 2008 6.4 with all the emissions stuff and low milage.
Help!!
