6.4L Power Stroke Engine and Drivetrain Discussion of the 6.4L Power Stroke diesel engine and drivetrain in the 2008 Super-Duty trucks. No gas engine discussion allowed except on transmissions and drivetrain that pertain to all models. Manual Transmission Rebuilt Before Purchase?

I purchased my truck with 16.5 miles on it via a dealer trade in northern MN. I took it in yesterday for service because I noticed there was transmission fluid leaking. When I called to check up on it, they said I had it in for service once before for the trans. I said, no I didn't. It turns out the first dealer did a transmission rebuild on it because the shifter fork (forgive me if my vocabulary is a bit off) was bent and the 5th gear throw-out bearing was not allowing the trans to stay in 5th. Well, it is now leaking from the boot on top of the trans where the shifter goes in. Is this something I should have been notified of prior to purchase, or should I just let them fix it and be done with it?

I also told them that 3rd gear grinds when it is cold, but is fine once it warms up. They said my CB may be the cause. It is placed (not bolted / screwed) between the dash and the boot. It is a little Radio Shack model. I know there is room because I put the trans in 3rd and 5th with my hand in between the boot and CB and was okay. Could they not honor the warranty because of that, if there needs to be work done on the 3rd gear parts?

As always, I know someone on here will be honest.

i don't know what the law is...whether or not they are required to inform you or not. maybe someone else can weigh in on that.

if it were my ride i would not be a happy camper!!! i would ask for a new o.e.m. transmission. using the line of thinking "i paid for a new truck with a new transmission, not a new truck with a rebuilt or reworked transmission!!!!"

they have to disclose something like that. Anything a dealer knows, must be disclosed.
And as for your cb, ask they what difference does the tranny temp make? Does your cb move when the truck is warm? I would call the ford area rep about this. dont fawking play the dealers little games.

They have to notify you of major repairs and damage. They also can't sell it as NEW if it's had major repairs or damage. I would request a new truck or at least a NEW trans and not a rebuild.

I can't speak to your transmission problem. But my 2008 F350 SC Dually was damaged while being unloaded from a railcar in Florida. It was repaired in Florida and bought by my dealership in Missouri. The first time I drove it, it only had 15 miles on it and the dealer was very upfront about the repair. So much so that I got a copy of the original estimate to fix and then the actual cost to repair. Damage was less than $600 to the right rear dually fender. I actually called down to the dealer in Florida and talked to the body tech that did the repair. Pretty minor. I was told by my dealer that damage over $500 had to be disclosed and that it would show up on the Oasis report.
My dealer was selling it as a used truck because it had to be titled when they bought it. I got it for almost $11000 off list without any rebates. I put the first 200 miles on it before I bought it and now have 4400 trouble free miles on it. I love this truck, it pulls my 4 horse gooseneck trailer like it's not even back there.
Have the dealer pull an Oasis report on your truck, that should tell you if there was any work done before you bought it

discloure laws vary with the state and often have different values before disclosure is required. A vehicle can have LOTS of things repaired and still be sold as new. New has to do with ever having been titled and not whether it has been repaired unless the repair made the vehicle a total loss by whatever your state defines as a total loss.
Untitled vehicles must have new parts used and can't used exchange (remanufactured) parts like your dealer can use to repair your already titled truck.

I got a new transmisssion on my Ex when it went out. I was not very happy.
If I were you I think I would tell them you want a whole NEW truck.

Simple to find out if the CB is the issue, take it out drive and drive it. If it still has trouble make them fix it. DEalers come up with the stupidest reasons not to take care of warranty issues. Sounds like that should have been disclosed to.

Okay. When I take it back I will ask about the Oasis Report. The service is being done at a local dealer...the truck was purchased about 1 hour north of me. I assume I would have to take the replacement / exchange question up with them?

The advantage I have is the dealership states the mileage the work was done, and I have my sales slip showing when I purchased it. I may have to contact a local lawyer for some back-up.

I do not think the CB had anything to do with 3rd gear.

Michael, I would definately take it up with your purchasing dealer,if for no other reason to get it on record that you know about it,that way if you start to have a lot of problems down the road it's documented,Good luck.

I worked dealer service depts 25 years or so.So heres my take on the issue.The trans was not rebuilt.It had a 5th gear shift fork and possably a 5th gear collar.Not a real major repair.It was under warrantyto the dealer same as you.Unless the trans was 70% ruined it would be repaired and not replaced(same thing to you the owner)Now 3rd gear grinding cold would require a big teardown and it might not get fixed.Lots of manuals grind a gear or two cold.Depends on HOW cold is cold,the weight&type fliud used(hopefully correct fliud)and trans could have a issue but cold grinds aren't that unusal.Just my 02 for what its worth.

How about if you found out the foundation on your new house was ruined due to settling or soil expansion and had been repaired. Bet you wouldn't feel so good about that.

You are right. IF the frame had been cut apart and put back together I'd want a new truck too. The frame having been cut and spliced would be well within disclosure amounts all states require be made. A manufacturer will readily replace a brand new, yet to be sold vehicle with a bent or damaged frame or one that fell off the truck on its roof.
Auomatic transmissions that get repaired, engines with oil leaks, and a multitude of other things get fixed regularly. That is why there is a pre-delivery inspection on new vehicles done by the service dept after it gets delivered off transporter.
