Ok,

I have an 05 F350 that has been under warranty continuously via factor, esp and now Diesel Care.

The truck has had the Banks system on it, and Ford is trying to blame the Banks equipment for two injectors failing.

I understand that since warranty coverage is continuous, they cannot reject this as it still falls under Magnusson/Moss act (sp?).

HELP, as I am now unemployed and cannot afford the repair.

Sorry to say but you just might have to eat the repairs unless you can prove that the Banks system didn't effect the injectors. The Magnuson-Moss Warranty Act does not cover after market performance enhancement products such as tuners. It was enacted so that you did not have to buy Ford filters or replacement parts for a stock truck. You may want to call Banks and see what they say and if they will help you in your defence, but don't expect much from them.

Ask Ford for their evidence that Banks caused the problem. THEY share the burden of proof not you. If all this is too much find a different dealer.

Another dealer is going to be your only hope, I would be shocked to see Banks step up and help you you will get Fed a "Ford has to prove it line".Other than that in reality you dont have a leg to stand on as far as makeing Ford pay since you have alterd the engines original programming.They also may have flagged your Vin in the system and Voided the engine warranty already.Check with another dealer but dont be shocked if your warranty is history.
